Pick Panic! Terms of Use

These Terms of Use (“Terms”) apply to your use of Pick Panic! (the “App”), a party ranking, drafting, voting, and selection game provided by LetsChat Ai LLC (“we,” “us,” or “our”).

By downloading, accessing, purchasing content through, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Entertainment Purpose

Pick Panic! is provided for personal entertainment. The App includes subjective rankings, fictional price tiers, categories, comparisons, and game results. These are not official ratings, professional analysis, endorsements, or statements of fact about any person or organization.

Sports rosters, player positions, team information, prices, categories, and other factual information may change or become outdated. We do not guarantee that every item is complete, current, or error-free.

2. Sports and Third-Party Non-Affiliation

Pick Panic! is an independent entertainment app. It is not affiliated with, associated with, authorized by, endorsed by, approved by, or sponsored by any professional or amateur sports league, association, conference, team, club, athlete, player, players’ association, governing body, broadcaster, or other third-party rights holder.

This includes, without limitation, the National Football League (NFL), National Basketball Association (NBA), Major League Baseball (MLB), National Hockey League (NHL), National Collegiate Athletic Association (NCAA), and their respective teams, members, players, affiliates, and related organizations.

The App may use the names of athletes, teams, leagues, organizations, brands, entertainment properties, public figures, or other third parties solely for identification, categorization, commentary, comparison, and gameplay. All third-party names, trademarks, service marks, trade names, logos, publicity rights, copyrights, and other proprietary rights belong to their respective owners.

LetsChat Ai LLC does not claim ownership of third-party names or marks. The appearance of a name or reference in the App does not imply an endorsement, partnership, sponsorship, license, or other official relationship.

3. No Gambling or Prizes

Pick Panic! does not provide real-money gambling, betting, wagering, lotteries, or cash prizes. Points, rankings, fictional prices, draft budgets, wins, and other game results have no cash value and cannot be exchanged for money or property.

4. Limited License and Acceptable Use

Subject to these Terms and Apple’s applicable terms, LetsChat Ai LLC grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial entertainment on devices that you own or control.

You agree not to:

Use the App for unlawful, fraudulent, abusive, or harmful purposes.
Copy, sell, sublicense, distribute, or commercially exploit the App or its content without permission.
Reverse engineer, decompile, disassemble, or attempt to obtain the App’s source code, except where applicable law expressly permits it.
Interfere with the App’s operation, security, purchases, or access controls.
Misrepresent an association with LetsChat Ai LLC, Pick Panic!, or any third party referenced in the App.

5. Local and Pass-and-Play Use

Multiplayer features are designed for local pass-and-play use on a shared device. Players are responsible for deciding who may access the device and for protecting information displayed during private turns.

Pick Panic! does not operate a public player profile, matchmaking, chat, or user-content publishing service.

6. User-Entered Content

The App may allow you to enter player names, custom categories, or custom list items (“User Content”). You are responsible for the User Content you enter and for ensuring that you have the right to use it.

You may not enter content that:

Is unlawful, threatening, harassing, discriminatory, or abusive.
Infringes another person’s intellectual-property or privacy rights.
Contains malicious code or is intended to interfere with the App.

You retain any rights you already have in your User Content. Entering User Content into the App does not transfer its ownership to LetsChat Ai LLC.

7. In-App Purchases

Pick Panic! may offer optional non-consumable in-app purchases, including premium game modes, premium categories, individual custom-list slots, and an unlock-all option.

Purchases are processed by Apple through the App Store and are associated with the Apple Account used to complete the transaction. Prices and purchase details are displayed before confirmation. We do not directly collect or process your payment-card information.

Purchase availability, restoration, refunds, billing, and use on additional devices are subject to Apple’s applicable policies, regional availability, device compatibility, and App Store rules. You can use the App’s “Restore Purchases” option to request restoration of eligible non-consumable purchases.

Refund requests are handled by Apple and may be submitted through reportaproblem.apple.com.

8. Privacy

Our handling of information is described in the Pick Panic! Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

9. Intellectual Property

Except for third-party material identified above, Pick Panic!, including its original software, branding, interface, design, gameplay presentation, written instructions, graphics, and other original materials, is owned by LetsChat Ai LLC or its licensors and is protected by applicable intellectual-property laws.

No rights are granted except for the limited right to use the App as described in these Terms and Apple’s applicable license terms.

10. App Availability and Updates

We may update, modify, suspend, remove, or discontinue features or content when reasonably necessary, including for maintenance, legal compliance, security, licensing, compatibility, or product-development reasons.

We do not guarantee that the App, every category, or every purchased feature will remain compatible with every device or operating-system version indefinitely. Nothing in this section limits rights that cannot legally be excluded.

11. Disclaimer of Warranties

To the maximum extent permitted by law, Pick Panic! is provided on an “as is” and “as available” basis, with all faults and without warranties of any kind, whether express, implied, or statutory.

We do not guarantee that the App will always be available, uninterrupted, secure, accurate, compatible, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by applicable law, LetsChat Ai LLC and its owners, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your access to or use of the App.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory rights available to consumers under applicable law.

13. Termination

These Terms remain effective while you use the App. Your permission to use the App may terminate if you materially violate these Terms. Upon termination, you must stop using the App, subject to any rights that cannot legally be restricted.

14. Apple Terms

Apps obtained through the App Store are licensed, not sold. These Terms supplement and do not replace Apple’s Standard Licensed Application End User License Agreement and the applicable Apple Media Services Terms and Conditions .

If these Terms conflict with Apple’s applicable terms concerning App Store licensing, transactions, or usage rules, Apple’s applicable terms control to the extent of that conflict.

Apple is not responsible for providing maintenance or support for Pick Panic! except as required by applicable law or Apple’s own terms. Nothing in the App or these Terms suggests that Apple endorses Pick Panic! or any statement about its quality or functionality.

15. Changes to These Terms

We may update these Terms when the App, our practices, or applicable requirements change. The updated Terms will display a revised effective date. Where required by law, we will provide additional notice or obtain consent.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except that mandatory consumer-protection laws in your jurisdiction may also apply.

17. Severability

If any part of these Terms is found unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
